This website is operated by BuiltByPELT AI Consulting LLC ("BuiltByPELT," "we," "us," or "our"), a North Carolina limited liability company based in Goldsboro, NC. By accessing or using this website, you agree to these Website Terms of Service. If you don't agree, please don't use the site.

These website terms govern your use of the marketing site only. Actual projects and services we perform for you are governed by a separate signed proposal, Statement of Work (SOW), or services agreement — see the Services Terms summary below.

2. Using this website

You agree to use this site lawfully and not to:

  • Interfere with or disrupt the site, its security, or its servers.
  • Attempt to gain unauthorized access to any system or data.
  • Scrape, copy, or republish our content without permission.
  • Misuse the AI assistant (for example, to generate unlawful, harmful, or abusive content).
  • Submit false information or someone else's personal information without authority.

3. The AI assistant

This site offers an AI chat assistant for convenience. A few things to know:

  • Responses are generated by AI and may be inaccurate or incomplete. They are informational only and are not a binding quote, contract, or professional advice.
  • Your messages are processed by a third-party AI provider (Google Gemini) to generate replies, as described in our Privacy Policy.
  • Please don't enter passwords, payment card numbers, or other highly sensitive data into the chat.
  • Anything important — pricing, scope, deadlines — is only binding when it's in a signed proposal or SOW.

4. Our content & intellectual property

The BuiltByPELT name, logo, slogan ("Empowerment on command."), site design, text, and graphics are owned by us or our licensors and are protected by intellectual property laws. You may view and share the site for normal, non-commercial purposes, but you may not copy, modify, or reuse our content or branding without our written permission.

The site may link to or rely on third-party services (such as our hosting, AI, and payment providers). We're not responsible for the content, policies, or practices of third parties. Your use of their services is subject to their own terms.

6. Disclaimers

The website and the AI assistant are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the site will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate.

7. Limitation of liability

To the fullest extent permitted by law, BuiltByPELT and its members, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of this website or the AI assistant. Our total liability for any claim relating to the website will not exceed one hundred U.S. dollars ($100). Liability for our paid services is addressed in the applicable signed agreement.

8. Governing law & disputes

These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. You agree that any dispute relating to this website will be handled in the state or federal courts located in North Carolina, unless a signed services agreement says otherwise.

We may update these terms from time to time. When we do, we'll update the "Last updated" date above. Your continued use of the site after changes means you accept the updated terms.

How our paid projects work

A quick, plain-English summary. The full, binding terms for any project live in your signed proposal or Statement of Work — this summary doesn't replace them.

Proposals & SOWs govern the work

Every project starts with a written proposal or Statement of Work describing the scope, deliverables, timeline, and price. That signed document — not this website or the AI assistant — governs the actual work. If anything here conflicts with your SOW, the SOW controls.

Deposits & payment

  • Most projects require a deposit to begin, with the balance billed at milestones or on completion, as set out in your SOW.
  • Invoices are payable through Stripe. Card details are handled by Stripe; we don't store full card numbers.
  • Late or unpaid invoices may pause work and, where allowed, accrue reasonable late fees as stated in your SOW.
  • Quoted prices exclude any applicable taxes and third-party fees unless we say otherwise.

Care plans & AI / metered usage

  • Ongoing hosting, support, and updates are provided under a monthly care plan, billed in advance and cancelable as described in your agreement.
  • AI features (the built-in assistant, personal AI assistants, voice, and similar) consume AI provider usage. AI usage is metered and billed at cost (or as stated in your plan). Heavy usage can increase costs; we'll work with you on sensible limits.
  • Care plans don't cover brand-new features or rebuilds outside the original scope — those are quoted separately.

Intellectual property & ownership

  • You own your final deliverables — the website, content, and custom configuration we build specifically for you — once your project is paid in full.
  • BuiltByPELT retains ownership of its own tools, frameworks, templates, code libraries, and know-how used to build your deliverables. We grant you a license to use those as embedded in your deliverables, but you don't acquire the underlying tools themselves.
  • Third-party and open-source components remain subject to their own licenses.
  • You're responsible for having the rights to any content, logos, or data you give us to use.

Warranties & disclaimers

We perform services in a professional, workmanlike manner. Except as expressly stated in your signed agreement, services and deliverables are provided without other warranties, express or implied. AI-generated outputs may contain errors and should be reviewed before you rely on them for business-critical decisions.

Limitation of liability (services)

To the fullest extent permitted by law, our total liability for any claim arising out of a project will not exceed the fees you paid us for that project, and we will not be liable for indirect, incidental, or consequential damages. Specific limits and remedies are set in your signed SOW.

Governing law (services)

Unless your signed agreement states otherwise, our services and these summary terms are governed by the laws of the State of North Carolina, USA.
